These General Conditions are applicable to the restaurant reservation service, hereinafter referred to as "Restaurant" provided to the user customer, hereinafter "Customer". The Restaurant makes use of the BOOKING-WEB booking service provided by E-group srl hereinafter "Service".
The reservation service provided by the restaurant to the customer is provided free of charge.
The booking service is provided by E-group srl at the Restaurant for the duration foreseen in the contract.
The Service provides the possibility that the Customer can request a reservation at the Restaurant through the online form.
To request a reservation, the Customer must enter his / her personal data requested in the form in addition to all the information useful to the Restaurant to provide the Customer Service. The Customer must ensure that the data entered is correct. At the end of the booking, the Customer will immediately receive an e-mail which will include all the data entered in the booking form. In the event that the customer does not receive this email he will immediately notify the restaurant via email. Upon receipt of the email, the Customer must verify that all the data entered is correct. In the event of errors, the Customer will promptly inform the Restaurant by e-mail stating the changes to be made. Any errors in the data entered by the Customer in the booking form (name, telephone, e-mail address, etc.) may lead to the cancellation of the reservation.
The availability of the number of seats in the restaurant may be limited.
The "Booking Requests" must be verified and confirmed by the Restaurant and cannot be considered confirmed and approved by the Restaurant. The Restaurant can freely cancel the Booking Requests based on the availability of the seats. The reservation will not be understood as effective until the receipt of an email in which the phrase "Booking confirmation" will be highlighted.
The reservation may be subject to a credit card guarantee. The Restaurant, if it considers it, can request a pre-authorization to guarantee the reservation that cannot be used for virtual payment methods. In the event that the customer, after having booked and entered the credit card details, if requested, should not be present at the lunch or dinner service in the time indicated in the booking request or if he should cancel the reservation beyond the limits defined in the " Cancellation policy "authorizes the Restaurant to withdraw from the Customer's bank account via credit card, the amount that was highlighted in the booking request and communicated in the email received from the Customer.
Inside the email received from the Customer after filling out the booking form, there is a link to check the "Booking Status" where there is also the possibility to cancel the reservation. The Customer has the right to cancel his / her reservation (Request or Confirmed) within the terms of the "Cancellation Policy" without any penalty. Once this is over, authorize the Restaurant, where provided, to charge the amount indicated in the booking form and reported in the email received from the Customer. The Restaurant may reserve the right to charge a penalty even if the Customer arrives with a lower number of people than the number indicated in the reservation, in this case the amount will be calculated based on the number of missing covers.
The Restaurant will use the data entered by the Customer to provide the requested Service and will keep data as required in the Privacy Policy. The Customer may request the deletion of personal data at any time. The Customer accepts that some non-personal data (day and time of booking, number of seats, presence of children / babies, etc.) can be used only for statistical purposes.
The credit card management service (verification, pre-authorization, authorization, etc.) is managed by Book-web in collaboration with Stripe. For the management of payments, the Restaurant will have a direct relationship with Stripe, therefore it will not be brokered by E-group. E-group is not responsible for Stripe's actions towards the Restaurant. In the case of a payment made via Stripe, the Restaurant will receive from them a bank transfer net of the bank commissions indicated on the site www.stripe.com - section Rates, if not previously agreed.
If the Customer does not show up at the Service or if the Customer cancels the reservation beyond the limit indicated in the "Cancellation Policy" the Restaurant has the right to use the amount committed with the credit card as payment for the withdrawal of the booking, considering this sum as a penitential deposit pursuant to art. 1386 cod. civ.
If the Customer presents the Restaurant to the Service and if the Customer explicitly requests it, the Restaurateur has the right to use the amount committed with the credit card as an advance payment, thus contributing to the total payment of the Service by applying the VAT rate in force (CC art. 1385 and following).
If the Restaurant requires the Customer a credit card to guarantee and the latter does not pre-authorize or does not make a pre-payment, in the event that the Customer does not show up or if the Customer cancels the reservation beyond the limit indicated in the “Policy of cancellation "the Restaurant has the right to charge the Customer the amount committed with the credit card as payment for the withdrawal of the booking, considering this amount as a penitential deposit pursuant to art. 1386 cod. civ.
E-group will use all the methods it knows to guarantee the security of the data and information entered in the reservations and stored on its servers. The booking request form will be protected by the SSL protocol. The credit card application form will be entirely managed by Stripe and protected by the SSL protocol. The Restaurant may not have access to the Customer's credit card information in any way. E-group cannot be held responsible for any damage suffered as a result of the Service provided to the Restaurant or provided to the Customer.
In the event of disputes with the Restaurant regarding the Service, the Customer will have to contact the Restaurant directly for the necessary clarifications.
The Restaurant reserves the right to change these General Conditions and notify the Customer
The Customer expressly and without reservation accepts all the clauses present in these General Conditions
